Litigation

Our litigators prosecute and defend cases in a wide range of commercial disputes, with particular focus on copyright infringement, entertainment litigation, art law litigation, and trademark infringement.
We recently won dismissal of false advertising claims against a publisher who used an author's pseudonym and author statements to promote a book. Antidote International Films, Inc. v. Bloomsburg Publishing Plc, et al.
We won a jury verdict in a highly contested dispute over ownership of the name of a prestigious dance competition, Mary de la Torre Bueno v. Dance Perspectives Foundation, Inc.
We wrote the winning amicus brief in federal appellate court in Manhattan in the landmark case on electronic publishing, Random House v. Rosetta Books.
We successfully represented the artist Al Hirschfeld in the litigation Hirschfeld v. Margo Feiden Galleries
Toby Butterfield is an experienced litigator who handles intellectual property, copyright, trademark and general commercial cases in federal and state courts.  He also counsels clients on various non-litigated matters. He is the Chair of the Committee on State Courts of Superior Jurisdiction at the Association of the Bar of the City of New York, and a member of the Community Advisory Board of WNYC, New York's Public Radio station.
Al J. Daniel, Jr. is primarily a trial and appellate litigator with substantial experience in disputes involving copyrights, trademarks, entertainment law, artists’ rights, and commercial law. Prior to entering private practice, he served as a trial and appellate attorney with the United States Department of Justice in Washington, D.C. and New York City. He is also involved in entertainment-related transactions and recently negotiated a recording contract with Sony Classical for a rising classical violinist.
Lisa K. Digernes practices primarily in the areas of intellectual property and entertainment law. Ms. Digernes has her law degree (Candidata Juris) from the University of Oslo, Norway, and her LL.M. degree in intellectual property from Benjamin N. Cardozo School of Law. She speaks fluent Norwegian and English and is proficient in Danish, Swedish and French.
Matthew A. Kaplan is a litigator who practices primarily in the areas of copyright, trademark and commercial litigation. He has represented companies in the computer sales, computer consulting and pharmaceutical industries.
Alexis Mueller practices in the areas of transactional entertainment law, technology law, digital media law, and intellectual property law with a focus on the licensing and prosecution of trademarks. In addition to his transactional work, he frequently assists litigation attorneys in intellectual property and general commercial cases in federal and state courts. He speaks German and French.
Mitchell E. Radin practices primarily in the area of intellectual property. He is well-known in the trademark field and is the head of the firm’s international trademark practice. His practice focuses on commercial transactions involving the licensing and sale of trademarks, copyrights, patents, technology, designs, and know-how and he counsels clients on trademark and copyright selection, adoption, use and registration, brand development, and dispute resolution, both in the United States and internationally.
Robert F. Van Lierop is a transactional attorney in the areas of entertainment law, real estate and international law. He has represented a number of acclaimed artists, producers, writers, and arts organizations. He is also an experienced litigator, and a former Ambassador/Permanent Representative to the United Nations. He is a life member of the Black Entertainment and Sports Lawyers Association (BESLA) and numerous other professional associations and civic organizations.
Mason A. Weisz is a commercial litigator whose practice primarily involves copyright, trademark, and related intellectual property matters, as well as cases relating to digital media. He speaks Spanish and French.
David Wolf, the head of our litigation practice, won a leading case on the use of offers of judgment in copyright cases, Jordan v. Time Inc. He wrote the winning amicus brief for map publishers in an important case on the copyright protection of maps, Mason v. Montgomery Data. He is Adjunct Professor in Copyright Litigation at Fordham University School of Law.
